Kitty Up Terms of Service
Please note you must be 18 years of age or older to commission Kitty Up Fursuits. A legal guardian is a suitable replacement if the client is underage. A contract will be sent for clients to sign off on as well. Failure to sign off on the contract, abide by contract, and/or abide by terms of service will result in the termination and cancellation of your project. These are for your protection and mine too! Please read them well.
Quotes and Payments
-
Quotes are valid for 6 months after they are given. It is recommended to only seek a quote if you plan to commission in this time frame.
-
A total estimate and a downpayment will be provided. If the client wishes to go through with the commission, the downpayment must be paid at minimum to secure the slot. Costumes will NOT be scheduled to the main queue or started until at least 75% has been paid.
-
Kitty Up Fursuits only accepts payments in USD.
-
Commissions $500 and over are eligible for payment plans. This requires a deposit equal to 30% of the total cost, of which $500 is NONREFUNDABLE.
-
The client is aware that $500 of their downpayment is nonrefundable. This small portion of the deposit secures their commission slot, purchases materials for their costume, as well as pays for the time spent on concept art and discussing the commission.
-
Payments are accepted only through PayPal invoices. If you do not have a PayPal and wish to use a credit/debit card, the invoice is still compatible with this. No account needed!
-
Your commission slot can be resold if you wish to drop out. This is an excellent alternative to providing a refund as you get the chance to make your full amount back. Please have the person you're reselling your slot to get in contact with me so we can approve their project and discuss potential additional payments.
Concepts and References
-
A clear reference of the client’s design must be provided. It needs to be unshaded and show any important details, or at least important details be mentioned. I sketch up custom concept art for each fursuit so a fursuit reference sheet may not be required.
-
I will go back and forth with the client until the concept art is perfect. This will be used to build your fursuit and give you an idea of the final product.
-
If the commission is artistic liberty, the reference will be completed once a downpayment is sent. This is included in the price of artistic liberty commissions.
-
In addition to my concept art, I will use references provided as well to capture your character as perfectly as possible. A fursuit friendly reference sheet is always welcome.
Completion, Deadlines, Shipping
-
Shipping is NOT included in your quote. Shipping varies between $50-$150 average. This is fully insured, 2-3 day shipping via UPS or USPS. We do ship overseas, but be aware that it may be expensive. Buyer is responsible paying import fees and other dues. Once it is out of the US, Kitty Up Fursuits is not responsible for the packages except for insurance collection if need be.
-
Shipping will ALWAYS include tracking and insurance. It will not be excluded just to save a few extra dollars.
-
Please note there may be fees if I have to hold onto your suit for an extended period of time after completion. You will incur a $50 holding fee every two weeks. If things are preventing you from receiving your suit, please talk to me about it beforehand and we can work something out.
-
If the buyer wishes to pay for rush delivery such as one day/overnight or seeks shipping through a different company, they may request it.
-
If the costume is lost in the mail, another will not be provided. The insurance collected will be used to refund the client in full.
-
If you have a deadline in mind, please be up front with it. A deadline is a great work motivator for me, but I cannot work with one sprung upon me suddenly.
-
The client will be kept fully updated with plenty of pictures about their commission. A form of communication will be decided when the client chooses to continue with their commission after receiving a quote.
-
Commissions are kept updated through the Kitty Up Fursuits Trello. If the client is curious, they can keep an eye on projects through there as well.
Cancellations, Design Changes, Repair
-
If the client wishes to cancel a commission, they are aware that $500 of the total is nonrefundable. The client can request a refund until work is started.
-
Once work is started, no refund will be provided and the commission will be finished as requested as my typical turnaround time from start to completion is 30 days.
-
If I do not finish the suit within 30 days, it is eligible for refund as I have failed to finish in my usual time frame. Refunds are based upon how much is completed minus the deposit. Completed suits cannot be refunded, but the client is welcome to resell it.
-
I am happy to work with a client to modify their commission into something else and resell it if they no longer desire it. The client will receive 70% of the resale, 30% will be kept for labor. If no modification is needed, I can resell the suit for the client and give 90% to them. 10% goes to me to cover shipping, the listing, so on.
-
If a project goes 6 months without contact from the client it will be considered abandoned. The work will be modified and resold, the funds from the sale going to a 70% refund of the total.
-
If the client wishes to change the design drastically or completely when a downpayment is sent, a fee may be charged if materials have been purchased.
-
Work in progress pictures and updates will be provided in excess to the client. This gives many opportunity for correction as needed. If the client does not speak up or waits until the costume is finished, fees will be charged to change anything.
-
All Kitty Up Fursuits work is given free minor repairs for life. The only thing needed is for the client to provide shipping to and from the workshop. Larger repairs or refurbishes are subject to prices and should be discussed between Kitty Up and the client.
-
I am happy to refurbish the work of other fursuit makers. Do contact the original maker if possible to make sure they are comfortable with this. Exceptions to this may be provided and are entirely situational.
-
If there is a problem, please speak up! I cannot fix something I don’t know about and I am more than happy to work with the client for their image.
Premade Fursuits
-
Photos are provided in excess to the client before any purchase is made. Any noted flaws, issues, or problems is mentioned prior to any discussion of money.
-
Premade fursuits are meant to fit a general size. Measurements are provided upon listing and it is up to the buyer to ensure that parts are a good fit before purchase
-
Returns and refunds cannot be made on premade fursuits once they have been shipped out. You are welcome to resell the costume on your own time. TheDealersDen is a great website for this.
-
Fursuits are bulky, hot, difficult costumes to wear by nature. While I build them to be as comfortable as possible, this is not a flaw. This is the inherit nature of it. This is not a valid reason for return.
-
If there's a problem with the premade fursuit, please reach out to me first. I'm happy to fix whatever I can.
Sizing, Other
-
Depending on the commission, some form of size comparison will need to be provided. Whether it be something such as a hand tracing, some quick measurements, or a DTD will be discussed with the client when they choose to pursue a commission. Please be aware of this.
-
Fursuits are handmade items. There may be small, cosmetic flaws present. Large flaws not caused by the client will be covered by Kitty Up Fursuits and repaired accordingly.
-
If Kitty Up Fursuits wishes to cancel a commission without a breach in contract, the entire commission will be refunded including the nonrefundable part of the deposit.
-
If there is a breach in contract, the client will be given opportunity to fix it. If no fix is provided, the client will be refunded everything excluding the nonrefundable $500.
-
Kitty Up Fursuits reserves the right to cancel a contract if needed, desired, or for any other reason. A proper refund will be provided.
-
Kitty Up Fursuits is not responsible for the misuse, injury, improper wearing, and otherwise unsafe usage of our work. It is up to you to take proper precautions when wearing a heavy, hot, vision limiting costume.
Do note that Kitty Up Fursuits is a pet friendly household. Your costume will likely have some exposure to cats.
By accepting a commission, you are aware of these terms, have read through them, and agree to adhere to them throughout your commission.
